RECOMMENDATION

Take the following actions: (1) Approve and authorize the Chairman to sign a retroactive revenue agreement with the California Department of Health Care Services for Medi-Cal Administrative Activities (Agreement No. 16-93379) in an amount not to exceed $900,000 for the period July 1, 2016 through June 30, 2019; (2) approve and authorize the Chairman to sign: (a) Certification Regarding Lobbying (Attachment 1 to Exhibit D(F)); (b) Contractor Certification Clauses (CCC-307), (c) California Civil Rights Laws Certification, and (d) Certification regarding lobbying; and (3) authorize the Health and Human Services Agency Director (HHSA), or any HHSA Branch Director designated by the HHSA Director, authority to execute: (a) the Contractor's Release Form (Exhibit F) at the end of the contract term; (b) prospective and retroactive amendments to the agreement that result in a change in revenue of no more than $90,000 (10 percent of the total budget); and (c) minor prospective and retroactive amendments to the agreement or other documents related to the agreement that do not result in a substantial or functional change to the original intent of the agreement, providing that all such amendments shall otherwise comply with Administrative Policy 6-101, Shasta County Contracts Manual.

SUMMARY

Approval of this agreement with the California Department of Health Care Services (DHCS) will allow for the maximization of Federal Financial Participation (FFP) reimbursement for Medi-Cal Administrative Activities (MAA) outreach activities in Shasta County through June 30, 2019.

DISCUSSION

MAA is a federal Title XIX Medicaid program (Program) intended to increase accessibility and utilization of Medi-Cal services to Medi-Cal eligible or potentially eligible individuals and their families.  This program allows FFP reimbursement for costs of outreach and education, program planning, and administration of related services specific to Medi-Cal programs, many of which are core public health activities that are otherwise funded with realignment.  The Program provides a mechanism for agencies to receive FFP funds equal to an established California rate of up to 75 percent of allowable costs.  Allowable costs for MAA activities include salaries and benefits, services and supplies, and overhead costs.  The program is administered at the state level by the DHCS.

 

Minor adjustments to this agreement may be necessary to most effectively implement the proposed activities.  An efficient way to make these minor modifications is to authorize the HHSA Director, or any HHSA Branch Director designated by the HHSA Director, to sign amendments for budget modifications in an amount not to exceed $90,000 (10 percent of the total budget) or minor program changes based on the needs of the target population.

 

The HHSA received the agreement from the DHCS on February 28, 2017.  The agreement is retroactive due to DHCS requiring language in the agreement to be updated.  DHCS had planned on amending the previous agreement to extend the term; however, due to the requirement for updated agreement language, a new agreement is required.  A summary of the updated agreement language is: the description of covered County-based MAA, revisions to parts of the Scope of Work, change to invoice and expenditure submission deadline, clarification of FFP requirements, addition to purpose of Business Associate Addendum, and addition of the California Civil Rights Laws Certification.

ALTERNATIVES

Alternatives include not approving the agreement or requesting changes to the terms of the agreement.

OTHER AGENCY INVOLVEMENT

County Counsel has approved the agreement as to form.  Risk Management and Information Technology have approved the agreement.  The recommendation has been reviewed by the County Administrative Office.

FINANCING

Projected revenue and related expenditures for this agreement were included in FY 2017-18 HHSA Public Health Branch (BU 411) Requested Budget and future projected revenue will be included in budget request submissions as necessary.  No additional County General Funds are requested with approval of this recommendation.
