| | | | | | | | RECOMMENDATION
Take the following actions related to Tract No. 2008, Foxrun Unit 2 Subdivision (Cottonwood area): (1) For the Beagle Street Permanent Road Division (PRD): (a) receive the petition for formation and the petition for activation; (b) receive an affidavit verifying information contained in the petition; (c) receive the maintenance cost estimate; (d) receive the County Surveyor’s report on the boundary description (in the form of a map); (e) receive the Consent and Waiver to Assess Annual Parcel Charge; (f) receive the annual parcel charge report; (g) adopt a resolution which forms the PRD; and (h) adopt a resolution which confirms the annual parcel charge report for Fiscal Year 2017-18; and (2) for Tract No. 2008, Foxrun Unit 2 Subdivision (Cottonwood area): (a) approve the Final Map for filing; (b) accept on behalf of the public, offers of dedication for public roads, bike path easements, public utility easements, and relinquished access rights as shown on the Final Map; and (c) approve and authorize the Chairman to sign a maintenance agreement with Community Housing Improvement Program guaranteeing workmanship on Tract No. 2008, Foxrun Unit 2 Subdivision (Cottonwood area) and accept a security for maintenance in the amount of $24,000. |

| | | | | | | | DISCUSSION
Tract No 2008 is a 24-lot subdivision on the west side of Locust Street in Cottonwood. On June 11, 2015, the Planning Commission approved the tentative map.
The developer was conditioned to form a permanent road division (PRD) to maintain roads within the subdivision. All of the subdivision lots are presently owned by the developer. They have petitioned the Board to form and activate the PRD. The proposed annual parcel charge is $206 per lot. Proposition 218 requires a public hearing and a vote of the affected property owners. The owner has executed a Consent and Waiver to Assess Annual Parcel Charge document. The owner has thus consented to waive any and all entitlement to notice of a public hearing and the right to protest the proposed annual parcel charge. The developer has constructed all required improvements. They request approval of the final map. Adoption of the attached resolutions and execution of the attached agreement will fulfill all approval requirements for the development. Staff recommends that the Board approve the final map for filing. |

State law requires the filing of the final map when all conditions of the tentative map have been met or bonded for. The Board may decline to form the PRD. The Board may then elect to have these maintenance costs borne by the County Road fund, or decline to have them maintained altogether. |
| | | | | | | | OTHER AGENCY INVOLVEMENT
The conditions of approval were established by the Planning Commission. County Counsel has approved the petitions, agreement, resolutions, and consent and waiver document as to form. The recommendation has been reviewed by the County Administrative Office.
