RECOMMENDATION

Take the following actions regarding the Old 44 Drive at Oak Run Creek Bridge Replacement Project, Contract No. 705927:  (1) Adopt a California Environmental Quality Act (CEQA) determination of a Mitigated Negative Declaration subject to the findings in the proposed resolution; (2) approve and authorize the Chairman to sign right-of-way contracts with: (a) Ronald and Louise Masingale for right-of-way valued at $8,944.34 for 0.06 acres; and (b) True and Leslie Myers for right-of-way valued at $5,800.00 for 0.23 acres and a Temporary Construction Easement valued at $1,700.00 for 0.28 acres; and (3) accept two Easement Deeds conveying the right-of-way parcels.

SUMMARY

Right of way acquisition is proposed for the Old 44 Drive at Oak Run Creek Bridge Replacement Project.

DISCUSSION

The County is preparing to replace the Old 44 Drive at Oak Run Creek Bridge.  The existing 20-foot-wide by 82.5-foot-long steel bridge is functionally obsolete.  A 33-foot-wide by 127-foot-long concrete box girder bridge is proposed.  The road will be closed to through traffic during construction.  A Mitigated Negative Declaration (MND) is proposed based on the Initial Study (attached).  There was a 30-day public comment period.  The project requires the acquisition of four permanent right of way parcels and two Temporary Construction Easements.  Agreements have been reached with two of the property owners.

ALTERNATIVES

The Board may decline to make the CEQA findings and acquire right of way.  The existing bridge would remain.

OTHER AGENCY INVOLVEMENT

Caltrans oversees the project funding.  County Counsel has approved the resolution and contracts as to form.  Risk Management has reviewed and approved the contracts.  The recommendation has been reviewed by the County Administrative Office.

FINANCING

The total project cost estimate is $2,800,000.  Federal funds will cover 88.53%.  Adequate funds are included in the 2016/17 Road Fund budget.  There is no General Fund impact.
