RECOMMENDATION Adopt a resolution which approves the Conflict of Interest Code of the Shasta Local Agency Formation Commission.

SUMMARY Government Code section 87300 mandates state and local government agencies to adopt and promulgate a Conflict of Interest (COI) code. Government Code section 87303 provides that a conflict of interest code shall not be effective until it has been approved by the code reviewing body; section 82041 describes the Shasta Local Agency Formation Commission as a “local government agency”; and section 82011(b) defines the board of supervisors as the code reviewing body for local government agencies.

DISCUSSION The Shasta Local Agency Formation Commission desires to adopt a COI Code and subsequently forwarded their proposed COI Code to be submitted to the Board of Supervisors for approval. The COI Code is being submitted for review and approval by the Board of Supervisors. It is requested that the Board of Supervisors adopt a resolution which approves the COI Code of the Shasta Local Agency Formation Commission.

ALTERNATIVES The Board of Supervisors may choose not to approve the COI Code; however, this will leave the Shasta Local Agency Formation Commission out of compliance with Government Code section 87303 and the California Fair Political Practices Commission regulations.
