| | | | | | | | RECOMMENDATION
Adopt a resolution which repeals Resolution No. 2006-193 and approves the
Conflict of Interest Code of the Clear Creek Community Services District.

| | | | | | | | SUMMARY
Government Code section 87300 mandates state
and local government agencies to adopt and promulgate a Conflict of Interest (COI)
code. Government Code section 87303 provides that a conflict of interest code
shall not be effective until it has been approved by the code reviewing body;
section 82041 describes the Clear Creek Community Services District as a “local government agency”; and section 82011(b) defines the
board of supervisors as the code reviewing body for local government agencies.

| | | | | | | | DISCUSSION
As the Board of Supervisors is the “code
reviewing body,” the Board of Supervisors approved the Clear Creek Community Services District's COI code on December 12, 2006 and established Resolution No. 2006-193. The Clear Creek Community Services District determined a revision to their COI Code had taken
place and the proposed COI Code was
forwarded to be submitted to the Board of Supervisors for approval.
The COI Code
is being submitted for review and approval by the Board of Supervisors. It is
requested that the Board of Supervisors adopt a resolution which repeals Resolution
No. 2006-193 and approves the COI Code of the Clear Creek Community Services District.

| | | | | | | | ALTERNATIVES
The Board of Supervisors may choose not to
approve the COI Code; however, this will leave the Clear Creek Community Services District out of
compliance with Government Code section 87303 and the California Fair Political Practices Commission regulations.

County Counsel has reviewed the COI Code and confirms that it is approved as to form. |
