RECOMMENDATION

Approve and authorize the Chairman to sign the following agreements for the distribution of Funds for the Fiscal Year 2016/17, Year 17 Carl Moyer Rural Assistance Program:  (1) Alturas Ranches LLC, in the amount of $100,000; and (2) Nicki Alves, dba Cloud’s Warner Mountain Ranch in the amount of $60,760.23.

DISCUSSION

The State of California annually allocates approximately $68 million to fund incentive programs to reduce emissions from heavy-duty diesel engines. The Carl Moyer Program is designed to reduce nitrogen oxide (NOx) emissions by providing grants that cover the differential cost of cleaner on-road, off-road, marine, locomotive, stationary pump, forklift and airport ground-support equipment engines. The District has received $100,000 for the Alturas Ranch project and $60,760.23 for the Cloud’s Warner Mountain Ranch project from the Carl Moyer Rural Assistance Program.  Resolution No. 2016-02 was adopted by the Air Pollution Control Board on April 5, 2016, authorizing the District to apply for and accept project grant funds for equipment and administration from the Rural Assistance Program.   This project was solicited through the California Air Pollution Control Officer’s Association (CAPCOA) office.  All projects funded through the Carl Moyer Program must be cost-effective (cost no more than $18,260 for each ton of NOx reduced). The Alturas Ranch project involves replacing a 1981 model year 275-horsepower engine tractor with a 2015 Final Tier 4 270 horsepower engine in a new tractor. The Cloud’s Warner Mountain Ranch project involve replacing a 1977 130 horsepower engine tractor with a 2016 Final Tier 4 135 horsepower engine.  Existing diesel engines in off-road agricultural equipment are currently not regulated by the Air Resources Board and therefore, their emissions are considered eligible for Carl Moyer funding. 
ALTERNATIVES

The Board may choose to do one of the following: 1) deny funding of the recommended projects; or 2) modify the proposed Agreements.
OTHER AGENCY INVOLVEMENT

County Counsel and Risk Management have approved the Agreement as to form.  The California Air Resources Board has reviewed the District’s applicability calculations.
FINANCING

The funding for the proposed project will be from Year 17 Carl Moyer Rural Assistance Grant funds.  Administrative funds in the amount of $8,571.43 have been received by the District.
