RECOMMENDATION

Adopt a resolution which repeals Resolution No. 98-146 and approves the Conflict of Interest Code of the Grant School District.

SUMMARY

Government Code section 87300 mandates state and local government agencies to adopt and promulgate a Conflict of Interest (COI) code. Government Code section 87303 provides that a conflict of interest code shall not be effective until it has been approved by the code reviewing body; section 82041 describes the Grant School Districtas a “local government agency”; and section 82011(b) defines the board of supervisors as the code reviewing body for local government agencies.

DISCUSSION

As the Board of Supervisors is the “code reviewing body,” the Board of Supervisors approved the Grant School District COI code on November 3, 1998 and established Resolution No. 98-146. In response to the 2016 Biennial Notice, the Grant School District determined a revision to their COI Code had taken place and the proposed COI Code was forwarded to be submitted to the Board of Supervisors for approval. The COI Code is being submitted for review and approval by the Board of Supervisors. It is requested that the Board of Supervisors adopt a resolution which repeals Resolution No. 98-146 and approves the COI Code of the Grant School District.

ALTERNATIVES

The Board of Supervisors may choose not to approve the COI Code; however, this will leave the Grant School District out of compliance with Government Code section 87303 and the California Fair Political Practices Commission regulations.

OTHER AGENCY INVOLVEMENT

County Counsel has reviewed the COI Code and confirms that it is approved as to form.

There is no General Fund impact associated with this action.
