| | | | | | | | RECOMMENDATION
Approve and authorize the Chairman to sign an amendment to the agreement with University of the Pacific, McGeorge School of Law for the provision of Hearing Officer services to: (1) Add Solid Waste and Intermediate Disciplinary Action Hearing Officer services; (2) update the notices section; (3) add a new provision to the termination section; (4) increase maximum compensation from $50,000 to $180,000 during the entire term of the agreement; and (5) add two one-year optional renewals. |
| | | | | | | | DISCUSSION
This amendment will provide Hearing Officer Services for any Shasta County Bargaining Unit which, in accordance with their respective Memorandum of Understanding (MOU), provides the option to appeal intermediate disciplinary action with an appeal hearing conducted and presided by a Hearing Officer. These services have been previously agreed upon with United Public Employees of California Shasta County General Unit (UPEC-General) specifically, in a separate agreement.
In addition, this amendment will provide for the assignment of a Hearing Officer who shall, preside over and conduct Solid Waste Hearings in accordance with Resolution 2008-052 for the Resource Management Department-Environmental Health Division. |
| | | | | | | | ALTERNATIVES
The Board may choose to not approve the amendment, but that would put the County out of compliance with Public Resources Code, Section 44308. In addition, not approving this amendment would put the County in conflict with the MOUs that have agreed with this method of resolving Intermediate Disciplinary Actions. |
| | | | | | | | OTHER AGENCY INVOLVEMENT
County Counsel has approved the amendment as to form. Risk Management has approved the amendment. The recommendation has been reviewed by the County Administrative Office. |

The financial impact of this recommendation will be budgeted accordingly within the respective County Department’s budget.
