RECOMMENDATION

Approve an amendment, effective date of signing, to the agreement with Stantec Consulting Services, Inc. to provide environmental services for the “Riverland Drive Widening Project,” Contract 702003, which increases maximum by $30,000 for a new maximum compensation of $260,000, retaining the term December 7, 2016 through December 31, 2023.

DISCUSSION

The work to widen the shoulders on Riverland Drive is nearing completion. Archaeological resources identified during environmental review have increased the complexity of environmental compliance. The proposed Seventh Amendment will increase maximum allowable compensation to account for the increased complexity.

 

On June 7, 2016, the Board entered into an agreement with North State Resources for project-related environmental studies. On February 7, 2018, the Board assigned the agreement from North State Resources to Stantec Consulting Services, Inc. On March 20, 2018, the Director approved the First Amendment to the agreement to incorporate Stantec labor rates. On April 16, 2019, the Board approved the Second Amendment increasing maximum compensation for additional studies as required by Caltrans. On June 25, 2019, the Board approved the Third Amendment increasing maximum compensation for additional studies. On December 10, 2019, the Board approved the Fourth Amendment increasing maximum compensation to conduct intensive archeological investigations. The Fifth Amendment extended the term of the contract to complete environmental studies and added additional compensation. The Sixth Amendment extended the agreement two years, provided for monitoring services during construction, and updated the consultant’s rates for the 2022 calendar year.

ALTERNATIVES

The board may decline to amend the agreement. The shoulder widening project is nearing completion. Failure to comply with environmental commitments could threaten the project’s federal funding.

OTHER AGENCY INVOLVEMENT

County Counsel has approved the amendment as to form. Risk Management has approved the amendment. The Recommendation has been reviewed by the County Administrative Office.

FISCAL IMPACT

Environmental compliance costs are part of total project cost. The Riverland Drive widening project has multiple funding sources – Federal Highway Administration Highway Safety Improvement Program (HSIP) funds will provide up to $924,000 and the County’s allotment of Federal Regional Surface Transportation Program funds will provide another $312,000. Gas Tax revenue will cover the remaining costs. Adequate appropriations are included in the adopted Fiscal Year 2022-23 Roads budget.
