RECOMMENDATION

Approve and authorize the Chairman to: (1) Sign a retroactive agreement with 3M Cogent, Inc., in the amount of $160,273.12 for the period June 1, 2015 through May 31, 2016; $160,273.12 for the period June 1, 2016 through May 31, 2017; and future annual maintenance fees capped at a three to five percent increase, to provide hardware and software maintenance and support for the Cogent Automated Fingerprint Identification System and Cogent Livescan fingerprint machines from June 1, 2015 until terminated by either party; and (2) sign an agreement with 3M Cogent, Inc., in the amount of $88,542 to provide replacement Livescan computers and palm scanners from the date of signing for a period of three years.

SUMMARY

Local automated fingerprint identification system (AFIS) and Livescan systems are an integral part of the processes and services that local law enforcement provide.  Continued maintenance and support is important to keep all machines operational and updated with the latest software and to facilitate hardware repair and replacement should a failure occur.  In addition, certain Livescan computers and palm scanners, initially purchased from Cogent, Inc. (now 3M Cogent, Inc.)(Cogent) have reached end of life and should be replaced.

DISCUSSION

On March 20, 2007, the Board of Supervisors approved an agreement with Cogent for the purchase of replacement Livescan equipment. These hardware devices and the associated software are used for capturing electronic fingerprints for non-criminal uses such as job applicant background checks and for capturing fingerprint and palm prints for arrests and other legislated purposes. Livescan machines are currently in place at the Redding Police Department, Anderson Police Department, Shasta County Juvenile Rehabilitation Facility, Shasta County Main Jail, Shasta County Sheriff’s Office Records Division, and the Shasta County Adult Alternative Custody Program Center. On June 28, 2011, the Board of Supervisors approved an agreement with Cogent to implement and provide AFIS for the Shasta County Sheriff's Office which assists crime scene technicians in identifying potential matches for partial fingerprints within minutes of submitting a search, with mobile identification devices in place it can help ensure wanted subjects are apprehended while preventing unnecessary detention of others, and allows authorized law enforcement personnel access to the local AFIS database for investigative purposes. AFIS and Livescan systems are an integral part of the processes and services that local law enforcement provide. Continued maintenance and support is important to keep all machines operational and updated with the latest software and to facilitate hardware repair and replacement should a failure occur. An agreement for maintenance only on the Livescan units ended on May 31, 2015. Discussions with Cogent on a comprehensive agreement covering the AFIS and Livescan systems began prior to the time the former agreement expired. Sheriff staff and Cogent have recently completed negotiating this agreement which includes the ability for County to switch to a time and materials basis due to funding uncertainties. Cogent has continued to provide support in the interim. In addition, some of these Livescan computers and palm scanners, not subsequently replaced under maintenance, have reached end of life and should be replaced.

ALTERNATIVES

The Board may decline to approve these agreements or may request additional information from staff.

OTHER AGENCY INVOLVEMENT

The Remote Access Network (RAN) Board supports this recommendation. County Counsel has approved the agreements to form. Risk Management and Information Technology have reviewed the agreements. The County Administrative Office has reviewed the recommendation.

FINANCING

The agreements are funded by the County Fingerprint Automation Penalty Assessment Trust Fund (Court Fines) which has sufficient fund balance to accommodate payment of these agreements through the end of this fiscal year and projected through the first quarter of the next fiscal year.  The Remote Access Network (RAN) Board will discuss future funding needs and resources.  There is no additional General Fund impact with approval of this recommendation.
