RECOMMENDATION

Adopt a salary resolution which, effective November 13, 2016, amends the County Salary Schedule and Position Allocation List to: (1) Modify the Child Support Attorney III Classification Specification to a minimum requirement of four years as a Child Support Attorney II; and (2) modify the Chief Child Support Attorney Classification Specification from Mid-Management Bargaining Unit to Management-Unrepresented.

SUMMARY

The Child Support Attorney III Class Specification states the “standards are typically attained with two (2) years of experience as a general practicing attorney; active membership in the State Bar of California.”  The department requests that the Child Support Attorney III Class Specification be modified to “standards are typically attained with four (4) years of experience as a practicing child support attorney; active membership in the State Bar of California.”

 

Additionally, the department requests that the County Salary Schedule and Position Allocation be modified to remove the Chief Child Support Attorney Position Allocation from the Mid-Management Budget Unit (MMBU) and add it to Management – Unrepresented.

DISCUSSION

Occasionally, as departments experience staff changes, job classifications are reviewed and changes are proposed that are more in line with the department’s current business needs.

 

The Child Support Attorney III will be designated as a lead position, able to fulfill the Chief Child Support Attorney’s duties should the Chief be absent.  The department purports that four (4) years of experience as a Child Support Attorney is appropriate to the level of responsibility held.

 

The Chief Child Support Attorney is a management level attorney working under the Department Head, with broad authority over the organizational development, and participates in executive-level decisions and personnel matters.  Additionally, the Chief is deputized to fulfill Department Head duties in the event that both the Department Head and the Assistant Director are absent and so a change in representation is requested.

ALTERNATIVES

The Board could choose not to approve one or both of the recommendations, could request additional information from the department, or could defer consideration to a future date.

OTHER AGENCY INVOLVEMENT

Support Services has prepared the Salary Resolution and Classification Specification and concurs with the recommendations.  The County Administrative Office has reviewed the recommendation. MMBU has been notified of the proposed recommendation.

FINANCING

There is no General Fund impact.  The department is already budgeted for two Child Support Attorney I/II/III positions and one Chief Child Support Attorney.
