RECOMMENDATION

Adopt a resolution which:  (1) Designates mental health professionals who may take, or cause to be taken, into custody persons for transportation to approved facilities for 72-hour mental health evaluation and treatment; and (2) repeals Resolution No. 2012-134.
SUMMARY

The Health and Human Services Agency (HHSA) recommends that the existing Resolution 2012-134 designating mental health professionals who may take, or cause to be taken, persons involuntarily into custody, be repealed with this new proposed resolution. The proposed resolution updates position titles to be authorized to write Welfare and Institutions Code (W&I) 5150 and 5585.50 holds and clarifies training requirements.
DISCUSSION

In addition to peace officers, W&I Sections 5150 and 5585.50 authorizes a county to designate professionals who may take, or cause to be taken, persons involuntarily into custody who are, as a result of a mental disorder, a danger to themselves or to others, or gravely disabled, for transportation to a facility approved for 72-hour evaluation and treatment. County Resolution 2012-134 currently designates various medical and mental health professionals to this role. The proposed new resolution keeps previous individuals and categories, and adds two specific individuals. These individuals previously held the authority but changed organizations, and this change resulted in losing their designation as stated in County Resolution 2012-134. The HHSA believes both individuals continue to be qualified and could provide a valuable service to the community in their new roles should they again be designated. In addition to adding these two specific individuals, HHSA is proposing to change the requirement of attending update trainings from once a year to once every two years (biennial). This change is consistent with general industry standards throughout other counties in California who operate formal designation and training programs.
ALTERNATIVES

The Board may choose not to adopt the proposed resolution to update eligible staff and clarify training requirements.
OTHER AGENCY INVOLVEMENT

County Counsel has reviewed and approved the resolution as to form. This recommendation has been reviewed by the County Administrative Office.
FINANCING

There is no additional General Fund impact associated with this recommendation.
