Approve and authorize the Chairman to sign the Acceptance of Offer of Dedication for Public Use for previously offered rights-of-way for Hyrax Road (Millville area).

A property owner requests Board acceptance of an offer of dedication for Hyrax Road per a 1994 Tract Map.

Hyrax Road is on the north side of Dersch Road in Millville.  In 1994, the Board approved Tract Map 1812 (Map).  Hyrax Road was offered for dedication for public road and utility purposes on the Map.  The Board consented to but did not accept the offer of dedication for Hyrax Road.

Mr. Dwight Demers owns three large parcels at the end of Hyrax Road, immediately north of the Map.  These lots have existing private appurtenant easements along Hyrax Road.  Mr. Demers has requested that the Board accept the 1994 offer of dedication to perfect a public easement along Hyrax Road.  A public easement would facilitate future development.

The Board may decline to accept the offer of dedication.  Existing private access rights would remain.

County Counsel has approved the resolution as to form.  The recommendation has been reviewed by the County Administrative Office.

Hyrax Road is privately maintained.  There is no General Fund impact.
