RECOMMENDATION

Provided that the Board of Supervisors has (1) Adopted a resolution which declares the property known  as APN: 055-370-021 (Property) no longer necessary for County use; (2) approved and authorized the Chairman, in accordance with the terms of that resolution, to sign a Real Property Purchase Agreement setting forth the conditions under which the County will transfer the Property to Pacheco Union School District; and (3) authorized the Chairman to sign a Quitclaim Deed, take the following actions:  (a) Conduct a public hearing; and (b) adopt a resolution vacating the public right-of-way in a portion of Pacheco School Road (County Rd No. 3H114) and a portion of Knighton Road (County Rd No. 3H11).

SUMMARY

The Pacheco Union School District (District) seeks to acquire County property interests in front of Pacheco School.

DISCUSSION

The County owns property and rights-of-way in front of Pacheco School (see Map).  Pacheco School Road provides optimum access to Pacheco School.  Parents routinely circumvent this layout by dropping school children off along Knighton Road.

 

Portions of the right-of-way are no longer required for street or highway purposes.  Staff proposes to vacate the surplus right-of-way along with the Property.  As part of the Real Estate Purchase Agreement which is the subject of a preceding Board item, the District is obligated to construct and maintain a fence along Knighton Road.  This is the final step in the property transfer process to allow the District use and ownership of the Property and the right-of-way proposed to be vacated.

ALTERNATIVES

The Board may decline to abandon the easements at this time.  No properties would transfer to the School.  The fence would not be built.  Existing land ownerships and uses would remain.

OTHER AGENCY INVOLVEMENT

The County Administrative office has reviewed this recommendation.  County Counsel has approved the resolution as to form.

FINANCING

The Adopted 2016/17 Road Fund budget includes sufficient funds to administer County rights of way.  There is no General Fund impact.
