| | | | | | | | RECOMMENDATION
Conduct a public hearing and take the following actions: (1) Adopt a resolution which, effective November 1, 2016, declares Assessor Parcel Number (APN): 055-370-021 and adjoining property (Property) no longer necessary for County use; (2) approve and authorize the Chairman, in accordance with the terms of the resolution, to sign a Real Property Purchase Agreement setting forth the conditions under which the County will transfer the Property to Pacheco Union School District; and (3) authorize the Chairman to sign a Quitclaim Deed in accordance with the terms of the resolution. |

The Pacheco Union School District (District) seeks to acquire County property located in front of Pacheco School. |
| | | | | | | | DISCUSSION
The County owns property and rights-of-way in front of Pacheco School (see Map). Pacheco School Road provides optimum access to Pacheco School. Parents routinely circumvent this layout by dropping school children off along Knighton Road.
The County has no use of the Property for its purposes. The Real Property Purchase Agreement sets forth the terms and conditions upon which the Property would be transferred to the District. As part of the Real Property Purchase Agreement, the District shall construct and maintain a fence along Knighton Road. Portions of the Property are encumbered by public easements which are proposed to be vacated by separate Board action. This action is contingent upon the Board also vacating the public easement adjacent to the Property. |

The Board may elect to retain the Property. The fence would not be built. Existing land ownerships and uses would remain. |
| | | | | | | | OTHER AGENCY INVOLVEMENT
Pacheco School has initiated this proposal. County Counsel has approved the agreement and resolution as to form. Risk Management has reviewed and approved the agreement. The County Administrative office has reviewed this recommendation. |
| | | | | | | | FINANCING
The Adopted 2016/17 Road Fund budget includes sufficient funds to administer County rights of way. There is no General Fund impact. |
