RECOMMENDATION

Take the following actions in accordance with Government Code §25526.6 regarding the Shasta Air Quality Management District's (AQMD) use of 24 square feet of roof space at 2640 Breslauer Way, Redding, CA:   (1) Find the action is exempt from the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines section 15301; (2) find that entering into a license agreement is in the public interest; (3) find that the area subject to the license will not substantially conflict or interfere with the use of the property by County; and (4) approve and authorize the Chairman to sign a no cost license agreement with the AQMD for the period November 16, 2016 through May 1, 2021. 

SUMMARY

On September 16, 2016, the California Air Resources Board provided notice to terminate the lease of 24 square feet of rooftop space at 2640 Breslauer Way, Redding, that contains meteorological equipment for air quality monitoring. The lease will terminate on November 15, 2016. The meteorological equipment is the property of the AQMD. The AQMD requests that a license agreement be approved in order to maintain the air quality monitoring station at its current location. 

DISCUSSION

The Shasta County Air Quality Management District has taken over the operation of the meteorological equipment located with the ambient air quality monitoring equipment located at 2640 Breslauer Way in Redding.  The State of California General Services Agency had a lease dated October 20, 2010 with Shasta County for the rooftop space occupied by the meteorological equipment.  The State has terminated that lease with a letter dated September 16, 2016 with an end date of November 15, 2016.  This license with the Air District is recommended to replace it. 

The California Air Resources Board installed the equipment in the late 1990s as part of their ozone transport study.  The equipment measures barometric pressure, outside temperature, wind speed and wind direction.  The equipment is co-located with the district’s ozone and particulate monitors and its data is continuously loaded into the district’s acquisition system .  This meteorological information is needed for the District to submit complete data to the state’s ambient air quality monitoring data system. This license for the rooftop space has a four and a half year term and will enable the district to continue to operate this equipment for that period of time.  Authority for entering into this license agreement is Government Code §25526.6 which provides as follows: “… [T]he board may grant or otherwise convey, … an easement, license, or permit for use of any real property of the county to …[a] public agency … in the manner and upon the terms and conditions as the board … determines or prescribes, upon a finding by the board or authorized county officer that the conveyance is in the public interest and that the interest in land conveyed will not substantially conflict or interfere with the use of the property by the county.  Gov. Code, § 25526.6    The AQMD has requested a written license in order to secure this rooftop space which houses the equipment necessary to maintain the air quality monitoring station currently operating on that site.  Air quality monitoring is in the public's interest. The rooftop area currently houses the meteorological equipment, therefore, approving the license will not substantially conflict or interfere with the use of the property by the County.  Leaving the equipment at its current location will ensure that the database remains intact and air quality monitoring can successfully continue.
ALTERNATIVES

The Board could choose not to approve the license agreement or request changes to the terms.

OTHER AGENCY INVOLVEMENT

County Counsel has approved the license as to form.  Risk Management has approved applicable language.  The department worked in conjunction with Resource Management staff to process the license.  Health and Human Services Agency staff was notified because the equipment is on the rooftop of 2640 Breslauer Way.

FINANCING

There is no General Fund impact associated with the approval of this recommendation.
