RECOMMENDATION

Approve and authorize the Chairman to sign an amendment to the agreement with Technical Resource Management, LLC dba Cordant Forensic Solutions, to update the legal name of the consultant and contact information, and to increase the maximum compensation not to exceed from $65,000 to $110,000 to provide additional alcohol and drug testing services, retaining the term July 1, 2015 through June 30, 2016, with two optional one-year renewals.

SUMMARY

LLC DBA Cordant Forensic Solutions does drug of abuse testing confirmation for the Health and Human Services Agency (HHSA)-Public Health laboratory.   Use of the services in this agreement during the final term far exceeded the two prior year terms, thus outpacing the available balance for the remainder of this agreement.  Therefore, the maximum compensation needs to be amended in order to continue receiving services.

DISCUSSION

The Health and Human Services Agency (HHSA) Public Health Laboratory is currently providing drugs of abuse and alcohol testing for HHSA - Children's Services and Probation. In some cases, confirmation testing for specific drugs and/or detection of extended markers of alcohol use are necessary and this contract allows the procurement of those services. The departments anticipate needing more confirmatory testing than the current maximum compensation allows before the end of the contract period.

The initial term of this agreement is one year, with two optional one-year renewals.  The HHSA - Public Health Branch will be performing a nationwide competitive procurement prior to expiration of this agreement. Technical Resource Management (TRM) has provided confirmation services in this capacity for approximately eight years, and has provided excellent customer service throughout that time. TRM is on the Federal Health and Human Services Agency list of approved Certified Laboratories and Instrumented Initial Testing Facilities.

ALTERNATIVES

Alternatives include not amending this agreement or directing the department to renegotiate all or part of the terms in this agreement, or direct the department to seek other alternatives for drugs of abuse testing services.

OTHER AGENCY INVOLVEMENT

County Counsel has approved the amendment as to form.   Risk Management has approved the amendment. The recommendation has been reviewed by the County Administrative Office.

FINANCING

HHSA- Public Health, the Probation Department, and HHSA - Children’s Services Fiscal Year 2017-18 Adopted Budgets includes sufficient appropriation authority for the activities described in this agreement. There is no additional General Fund impact with approval of the recommendation.
