RECOMMENDATION

Take the following actions for Assessor's Parcel Number 057-520-015-000 (Anderson area): (1) Find the project categorically exempt in conformance with the California Environmental Quality Act (CEQA) Section 15316 Guidelines, Class 16-Transfer of Ownership of Land in Order to Create Parks and Section 15325 Guidelines, Class 25-Transfers of Ownership of Interest In Land to Preserve Existing Natural Conditions and Historical Resources; (2) approve and authorize the Chairman to sign a Real Property Purchase Agreement with Thomas R. Semingson and Judy Semingson in the amount of $301,345.51; (3) accept the Grant Deed for the property; (4) approve a budget amendment increasing appropriations and revenue by $301,346 in the Land, Buildings and Improvement budget; and (5) approve a budget amendment increasing appropriations by $301,346 in the Accumulated Capital Outlay budget.

SUMMARY

It is recommended that the Board re-purchase the Balls Ferry Park parcel.

DISCUSSION

The Balls Ferry Park parcel adjoins the Balls Ferry Boat Ramp.  In 2005, the County sold the Balls Ferry Park parcel to Mr. and Mrs. Semingson.  It has since come to light that a state grant had funded park improvements with attendant deed restrictions.  Agreement has been reached with the owners to re-purchase the property for the original purchase price of $301,345.51.

ALTERNATIVES

The Board my decline to purchase the property at this time.  Grant terms restricted sale and use of the parcel.

OTHER AGENCY INVOLVEMENT

County Counsel has approved the agreement as to form.  Risk Management has reviewed and approved the agreement.  The recommendation has been reviewed by the County Administrative Office.

FINANCING

Adequate resources are available within the Accumulated Capital Outlay fund to transfer into the Land, Buildings and Improvement fund for the purchase of the parcel.  There is General Fund Impact with the recommended action.
