RECOMMENDATION

Appoint Frank Schabarum to the Bella Vista Water District Board of Directors to fill a vacancy on that Board to December 2019 or such other time as authorized by law.

DISCUSSION

The Bella Vista Water District is a California Water District.  Under the California Water District Law, a vacancy on the District's Board of Directors shall be filled pursuant to Government Code section 1780.

Government Code section 1780 establishes the following general procedure.

a.         Within 60 days after either the date on which the Bella Vista Water District (BVWD) Board of Directors is notified of the vacancy or the effective date of the vacancy, whichever is later, the BVWD Board of Directors may fill the vacancy by appointment.  Government Code section 1780(d)(1).

b.         If the vacancy is not filled by appointment by the BVWD Board of Directors within that 60 day period, then the Board of Supervisors may fill the vacancy by appointment within 90 days of the date the BVWD Board of Directors is notified of the vacancy or the effective date of the vacancy, whichever is later.  Government Code section 1780(f)(1).

c.         If, within 90 days of the date the BVWD Board of Directors is notified of the vacancy or the effective date of the vacancy, whichever is later, the remaining members of the BVWD Board of Directors or the Board of Supervisors have not filled the vacancy and no election has been called for, then the BVWD Board of Directors shall call an election to fill the vacancy. Government Code section 1780(g)(1).

Jeff O. Steppat resigned from the BVWD Board of Directors effective June 6, 2017. ., The BVWD Board of Directors was notified of Mr. Steppat's resignation at l its meeting on June 26, 2017.  On June 26, 2017, the BVWD Board of Directors declared a vacancy on its Board of Directors and posted a Notice of Vacancy on June 29, 2017 pursuant to Government Code section 1780.

However, the BVWD Board of Directors did not make any appointment to fill the vacancy within the 60 day period outlined above. 

On August 28, 2017 the BVWD Board of Directors adopted a resolution to recommend Frank Schabarum be appointed by the Board of Supervisors. Mr. Schabarum will hold office until December 2019 or such other time as authorized by law.

ALTERNATIVES

The Board may choose not to make the appointment and order the independent special district to hold an election to fill their vacancy.

OTHER AGENCY INVOLVEMENT

The Bella Vista Water District supports the recommendation. County Counsel has reviewed the recommendation.

FINANCING

There is no General Fund impact associated with approval of the recommendation.
