RECOMMENDATION

Take the following actions pursuant to the request for bids for lease of property at West Central Landfill for purposes of siting a gas-to-energy project:  (1) Open and read aloud all written, sealed bids received by the Clerk of the Board by 4:30 p.m. on August 14, 2017; (2) call for and receive oral bids; and (3) continue this matter to August 22, 2017, to consider final acceptance of the highest bid submitted which conforms to all terms and conditions specified in the resolution of intention to lease and which is made by a responsible bidder.

SUMMARY

Bids will be accepted to lease property at West Central Landfill for a gas-to-energy project.

DISCUSSION

Landfills generate landfill gas which can be used to generate electricity.  The County is seeking to contract with a private developer to develop a gas-to-energy project at West Central Landfill. A small portion of landfill property must be leased to a developer to site the project.

 

On July 25, 2017 the Board initiated the bidding process by adopting Resolution No. 2017-074 in accordance with Government Code sections 25520 – 25539. Written bids were to be delivered to the Clerk of the Board by 4:30 p.m. on August 14, 2017.  Pursuant to Government Code section 25530, at the August 15, 2017 Board meeting, all sealed proposals shall be opened, examined, and declared by the Board. Before accepting any written proposal, the Board shall call for oral bids for the lease of said real property and, if upon calling for bids, any responsible person offers to lease said real property upon the terms and conditions specified in this resolution and Lease, on file with the Shasta County Department of Public Works, for a monthly rental price exceeding by at least five percent the highest written proposal for said real property which is made by a responsible person, then the oral bid which is the highest shall be accepted for consideration.

ALTERNATIVES

The Board may decline to lease property at the landfill. The gas-to-energy project would not proceed.

OTHER AGENCY INVOLVEMENT

County Counsel has been involved throughout the process. The County Administrative Office has reviewed this recommendation.

FINANCING

All landfill activities are fee-supported. Sufficient funds have been included in the Adopted FY 2017-18 Solid Waste Budget to operate the landfill and pursue gas-to-energy proposals. There is no General Fund impact.
