RECOMMENDATION

Take the following actions regarding the "Olinda Road Widening Cycle 5 Project," Contract No. 702977: (1) Find the project categorically exempt in conformance with the California Environmental Quality Act (CEQA) Guidelines Section 15301, Class 1-Existing Facilities; (2) approve and authorize the Chairman to sign right-of-way contracts with: (a) Nicholas Magallanes and Kathryn Magallanes for right-of-way valued at $3,000 plus a Federal Highway Administration (FHWA) signing incentive of $1,000 for 1.13 acres; (b) Donald Hawkins and Cynthia Sellers for right-of-way valued at $2,400 plus a FHWA signing incentive of $1,000 for 0.24 acres; (c) Harry Weldin and Connie Weldin for right-of-way valued at $2,000 plus a FHWA signing incentive of $1,000 for 0.17 acres; (d) David Lonie and Sharon Lonie for right-of-way valued at $6,600 plus a FHWA signing incentive of $1,000 for 0.20 acres; (e) Frederick Eiszele and Pamela Eiszele for right-of-way valued at $3,500 plus a FHWA signing incentive of $1,000 for 0.20 acres; (f) Joseph Fitzpatrick and Katherine Fitzpatrick for right-of-way valued at $3,300 plus a FHWA signing incentive of $1,000 for 0.22 acres; (g) Cameron Macleod for right-of-way valued at $500 plus a FHWA signing incentive of $1,000 for 0.10 acres; (h) Michael Heim and Tina Heim for right-of-way valued at $600 plus a FHWA signing incentive of $1,000 for 0.10 acres; (i) Kenneth Sanders and Laura Sanders for right-of-way valued at $1,400 plus a FHWA signing incentive of $1,000 for 0.50 acres; and (j) Kao Saelee for right-of-way valued at $700 plus a FHWA signing incentive of $1,000 for 0.10 acres; and (3) accept ten Easement Deeds conveying the right-of-way parcels.

SUMMARY

Right-of-way acquisition is proposed to widen Olinda Road.

DISCUSSION

The County is preparing to construct paved shoulders along two miles of Olinda Road from Green Leaf Lane to Sammy Lane. The project is funded through the federal Highway Safety Improvement Program (HSIP). The project qualifies as a Categorical Exemption under the California Environmental Quality Act as a minor alteration of an existing highway. The project will require the acquisition of right-of-way parcels from 14 property owners. Agreements have been reached with ten owners.

 

Local agencies may offer a bonus to property owners who sign in a timely manner. The incentives must be offered equally to all property owners and are reimbursable by FHWA. All of the ten subject property owners signed within the requisite sixty days of accepting the first written offer. Four property owners remain. One property owner signed in a timely manner but there is a minor technicality with a name. One property changed ownership at the last minute and a new offer has been issued to the new owner. One property is in bank ownership after a foreclosure. The final property is a very large holding which remains under negotiation.

ALTERNATIVES

The Board may decline to make the CEQA findings and/or acquire the right-of-way.  The acquisitions are necessary to construct the project.

OTHER AGENCY INVOLVEMENT

Caltrans oversees the project funding.  County Counsel has approved the contracts as to form.  Risk Management has reviewed and approved the contracts.  The recommendation has been reviewed by the County Administrative Office.

FINANCING

The total project cost estimate is $1,500,000.  Federal funds will cover 90%.  Adequate funds are included in the Adopted FY 2017/18 Roads budget.  There is no General Fund impact.
