RECOMMENDATION

Approve and authorize the Chairman to sign an amendment to the agreement with the California Department of Corrections and Rehabilitation (CDCR) increasing compensation by $1,661,660 for a new total not to exceed $2,659,020, and extending the term for an additional five years through June 30, 2022 for the provision of CDCR jail services consisting of housing Shasta County inmates in State Fire Camps in the amount of $81 per inmate/day during training and $10 per inmate/day thereafter.

DISCUSSION

Shasta County entered into an agreement with CDCR in May 2014 to house Shasta County inmates at CDCR Fire Camps. CDCR shall provide custody and care pursuant to Minimum Standards for Local Detention Facilities set forth in California Code of Regulations Title 15, and 24 and in accordance with all applicable Federal, State and local laws, regulations and directives for each Shasta Sheriff inmate transported to CDCR for housing under this agreement. Health Care services are discussed within the contract. Approval of this amendment will continue to allow an inmate to serve their stay in custody and gain some vital employment skills while incarcerated in the CDCR facility. This agreement is open for those inmates meeting placement criteria, both male and female, who pass a medical health screening.  The inmate will receive a two-to-one credit (for everyone one day served the inmate will receive two days credit) based on behavior within the CDCR facility.

 

The inmates, while at the CDCR facility will go through an extensive training program to prepare them to be assigned to a designated Fire Camp. While in the Fire Camps, the inmates will be assigned daily tasks to complete, assigned to a work crew for off-site duties, and when needed, respond for fire suppression duties.  When eligible inmates are assigned to the camps it will free up bed space at the Main Jail.

ALTERNATIVES

The Board may choose to request changes to the terms and conditions of the agreement, may choose to delay approval for the agreement until a later date, or may choose not to approve the agreement which would result in the return of any inmates currently being housed at CDCR under this agreement. 

OTHER AGENCY INVOLVEMENT

This amendment has been approved as to form by County Counsel.  It has been reviewed and approved by Risk Management. The County Administrative Office has reviewed this recommendation.

FINANCING

The First Amendment, approved by the Board on January 27, 2015, increased the total compensation not to exceed $997,360.  This Second Amendment will extend the term of that agreement and allow the Sheriff to continue housing inmates at CDCR Fire Camps through June 30, 2022.  With the additional extension of term, the maximum compensation is being increased by $1,661,660 from $997,360 to $2,659,020.  Shasta County shall reimburse CDCR for the housing of inmates at the daily rate of not more than $81 per day while in training and $10 per day thereafter. A “housed” inmate is defined as an inmate who has been placed into the population of a CDCR run facility. Therefore, Shasta County will only pay for actual jail beds used by Shasta County.  Funds and appropriations are included in the FY 2017-18 Sheriff’s Office Jail budget for these contract beds, including transportation and medical costs.
