Retroactive First Amendment to the Agreement with NMS Labs, for the provision of providing forensic toxicology laboratory services.

RECOMMENDATION

Approve and authorize the Chairman to sign a retroactive amendment, effective October 1, 2016, to the agreement with NMS Labs to provide forensic toxicology laboratory services which increases the maximum compensation for the entire term of the agreement from $50,000 to $110,000, replaces Exhibit A with Exhibit A-1 (Fee Schedule), and adds one additional automatic one-year renewal to extend the term through June 30, 2018.

DISCUSSION

On June 25, 2014, the County Executive Officer signed an agreement with NMS Labs, for the purpose of performing forensic toxicology services for the Coroner’s Office.   This recommended First Amendment with NMS Labs will increase total compensation by $60,000 for a new total of $110,000 and will retroactively cover services back to October 1, 2016. This amendment is retroactive due to an increased need for additional forensic toxicology services due to the hiring of a full-time Forensic Pathologist and an inadvertent oversight in the amount of compensation already paid to NMS Labs.

The Board may request changes to the amendment.

OTHER AGENCY INVOLVEMENT

Risk Management has reviewed and approved this First Amendment. County Counsel has approved this First Amendment as to form. The County Administrative Office has reviewed this recommendation.

FINANCING

Appropriations for professional services are included in the Sheriff’s Coroner 2016-17 fiscal year adjusted budget.  Due to unanticipated increased expenditures in Services and Supplies related to having a  full-time forensic pathologist on staff, the Sheriff’s Office will be monitoring these expenditures closely and may need to bring a budget amendment to the Board to increase appropriations; however, the Sheriff’s Office will look to do so by reducing other Sheriff’s budget appropriations to stay within the current budget if at all possible. There is no anticipated additional General Fund impact with approval of this recommendation.
