RECOMMENDATION

Adopt a resolution which adopts an exception to the 180-day waiting period for the hiring of a CalPERS retiree, Government Code sections 7522.56 and 21221(g), for the interim appointment of Mark Castagnoli to the position of Chief Public Health Microbiologist effective May 20, 2017 through September 30, 2017.

DISCUSSION

Pursuant to Article 4 California Public Employees’ Pension Reform Act of 2013, California Government Code Section 7522.56, a retiree of the California Public Employees’ Retirement System (CalPERS) may not be employed with a CalPERS Agency within 180 days of their retirement date. However, if a critical need is determined, the CalPERS Agency may adopt a resolution which adopts an exception to the 180 day waiting period if all criteria are met for the exception.

 

The Chief Public Health Microbiologist serves as the Health and Human Services Agency (HHSA)-Public Health Branch Public Health Laboratory Director. Upon the announcement of Mark Castagnoli’s retirement effective May 19, 2017, a recruitment was conducted to fill the vacancy. However, the recruitment failed and due to the requirement of a Laboratory Director to oversee the Public Health Laboratory, this request for interim appointment is of the utmost importance to the business operations of the HHSA Public Health Branch.

ALTERNATIVES

The Board may choose to not adopt the resolution; however this is not recommended as the interim appointment of the Chief Public Health Microbiologist is of an urgent nature, critically needed, and a requirement.


OTHER AGENCY INVOLVEMENT

The County Executive Officer concurs with this recommendation.


FINANCING

The funding of the interim appointment will be included in the corresponding budget.
