Approve and authorize the Chairman to sign a retroactive renewal Memorandum of Understanding with the City of Redding for AB109 Realignment Compliance Operations for the period July 1, 2016 through June 30, 2019 with maximum compensation in Fiscal Year 2016-17 not to exceed $172,927 and actual maximum compensation in Fiscal Years 2017-18 and 2018-19 not to exceed the amount appropriated within the Sheriff’s Budget for Redding Police Department compliance operations as approved by the Community Corrections Partnership Executive Committee and the Board of Supervisors for those subsequent fiscal years. |

| | | | | | | | DISCUSSION
On June 28, 2011, the California Legislature passed a budget that implemented the Public Safety Realignment Act. Assembly Bill (AB) 109 and its subsequent trailer bill AB 117 transferred responsibility for supervising certain low-level offenders released from the California Department of Corrections and Rehabilitation to counties. AB109 and AB 117 designated the local Community Corrections Partnership (CCP) as the entity tasked with the responsibility of developing and recommending to the Board of Supervisors a plan to address the supervision, incarceration, revocation hearing, and service needs of this population. The Shasta County Public Safety Realignment Implementation Plan as approved by the Shasta County Board of Supervisors on June 17, 2014, includes a program for Compliance Operations to enhance accountability of this offender population. Compliance Operations are conducted by members of the Shasta County Sheriff’s Office, the Redding Police Department (RPD), and the Shasta County Probation Department.
This renewal MOU formally outlines the responsibilities of RPD and the Sheriff’s Office while providing flexibility for operational changes to better provide these services over time. Compensation for actual costs of the Redding Police Department to provide these services is specified for Fiscal Year 2016-17 as not to exceed $172,927. Future fiscal year maximum compensation to reimburse RPD for Compliance Operations shall not exceed the amount approved by the CCP’s Executive Committee (CCPEC) and the Shasta County Board of Supervisors for those respective budget years. The Board of Supervisors retains ultimate authority over the budget allocations.

The Redding Police Department supports the MOU and the Redding City Council on June 21, 2016 approved and authorized the Mayor to sign the MOU, which was subsequently signed by the Mayor on November 15, 2016. County Risk Management has reviewed and approved the MOU. County Counsel has approved the MOU as to form. The County Administrative Office has reviewed this recommendation. |

Funding for Sheriff’s Office and Redding Police Department Compliance Operations activities are appropriated in the Sheriff’s Patrol Budget and are funded through State of California Realignment (AB109) revenues. The $172,927 for FY 2016-17 is included in the Sheriff’s Patrol Adopted Budget. No additional General Funds are requested. Revenue and appropriations for MOU costs for FYs 2017-18 and 2018-19 are dependent upon future approval by both the CCPEC and the Board of Supervisors. |
